These Terms of Use and Purchase regulate your use of the Frinsports Portal and the purchase of tickets through it. By accessing and using the Portal, you agree to these Terms and acknowledge that you are aware of the guidelines established in accordance with the General Data Protection Law (LGPD).

Definitions

User – these are athletes who access the portal using a login and password, as well as event organizers who hire Frinsports services to use online registration services, having access to the administrative area of their event. 

Organizers – are the service providers directly responsible for organizing sporting activities.

Event – designates the sporting activities registered on the Portal. 

Frinsports – company that owns the Frinsports.com Portal (“Portal”), which owns the technology for selling registrations to online events and e-commerce of products.

Services for athletes – The Portal provides Users with a set of information about third-party events and the respective sale of online registrations. In addition to registration services, the Portal also offers e-commerce services for sporting products and photographs of participants in events.

Services for organizers – Organizers will have access to an administrative area where management reports, registration history, among other services defined in specific contracts will be available.

Mailing services – When registering on the Portal, athletes will be able to choose whether or not they wish to receive emails, SMS or direct mail with information about events and promotions. The service of sending emails, SMS and/or direct mail will only be provided with the User's consent. If the User has chosen to receive e-mails, SMS and/or direct mail, we inform you that this service can be deactivated at any time, simply by clicking on the opt-out link located in the footer of the e-mail.

Delivery of gifts, kits, chips and prizes – Each organizer will previously define the rules regarding the offering of gifts (t-shirts, bags, equipment, kits), prizes and chips, as well as the respective delivery locations. Follow the Portal, the official event websites or consult the regulations for specific information about gifts, chips and prizes. All questions regarding the delivery of gifts, kits and prizes (change of date, location, necessary documents) must be dealt with directly with the Event Organizer, as they are services provided by them.

Registrations 

General – To register, simply locate the event through the Events Calendar and click on “Register”. For people without a login and password, registration on the platform is done at the time of registration. Registrants will receive, as soon as they complete their order, an email informing them of the approval deadline for each payment method. After the request is approved, another email is sent confirming the registration. If the User does not receive this email, simply access Frinsports.com and check the registration status on the “My orders” link. If your registration is confirmed, you can print your registration receipt.

Registration of minors – According to CBAt (Brazilian Athletics Confederation) guidelines, to register minors in sports competitions, a written document of authorization from the parents or legal representative is essential, as well as a copy of the documents of the minor and the guardian, which will be delivered at the time of registration. chip collection or forwarded to the organizer, as applicable.

Elderly registration – Most events establish specific rules regarding the registration of the elderly category. For those events that do not allow registration directly through the Portal, we ask that the User contact the Event Organizer directly to find out the specific online and/or physical registration procedures.

Cancellation of registrations – Registrations will be automatically canceled if payment is not authorized by credit card administrators on the same day as the registration request. In the case of payment made via bank slip, the payment deadline must be observed, under penalty of immediate cancellation. In both cases, to register for the event, it is necessary to generate another registration request.

Canceled orders – If the order is canceled, a new registration must be made. The canceled order will be disregarded and there will be no charge.

Withdrawal of registration – Cancellation of registration can be carried out within a maximum period of 07 (seven) calendar days, counting from the date of the registration request, as provided for in the Consumer Protection Code. In this case, only the registration fee will be refunded. To request the cancellation of your completed registration, you must contact us through the communication channels available on the Portal.

Change of ownership – Changing ownership of the registration will not be permitted. Registration is personal and non-transferable.

Modality change – Changes to the race modality will only be permitted within a period determined by the event organizer. To request a change to the type of registration you have completed, you must contact us through the communication channels available on the Portal.

Exchanging registrations – Exchanging registrations between events registered on the Portal is not permitted.

Frinsports Responsibilities

Frinsports is a Portal that facilitates the dissemination and sale of tickets for events organized by third parties and is only responsible for completing the user's registration carried out through the Portal. When purchasing tickets through Frinsports, the User participates in events whose implementation is the exclusive responsibility of the respective organizers.

Although Frinsports strives to ensure the accuracy and completeness of the information provided about the events listed on the Portal, it is not responsible for any changes, cancellations, postponements, or any other circumstances that may affect the holding of the event.

It is important to highlight that any complaints, disputes or questions related to the organization, quality, safety, or any other aspect of the events must be addressed directly to the event organizers. Frinsports does not assume responsibility for any damages, losses or inconveniences arising from participation in events published on the Portal.

By using the services and purchasing event tickets, the User agrees to exempt Frinsports from any liability related to the holding of the events, recognizing that Frinsports is only an intermediary in facilitating the purchase and sale of tickets.

Responsibilities Organizers

When using Frinsports services to list and sell tickets for your event, the Organizer acknowledges and agrees that it is exclusively responsible for the realization and execution of the event advertised on the Portal.

Frinsports acts only as an intermediary in facilitating the sale of tickets and the transfer of payments to event organizers. Frinsports is not responsible for the organization, quality, safety, or any other aspect related to the event.

It is the responsibility of the Event Organizer to ensure that all information provided about the event is accurate and up to date, including relevant dates, times, location and descriptions. Additionally, the Organizer is responsible for providing participants with all necessary information about the event, including cancellation policies, refunds and any specific requirements.

Any disputes, complaints or issues relating to the holding of the event must be dealt with directly with the organizer. Frinsports does not assume responsibility for any damages, losses or inconveniences arising from participation in events published on the Portal.

By using the Portal services to list and sell tickets for your event, the Organizer agrees to exempt Frinsports from any liability related to the holding of the event.

Other responsibilities

The User is responsible for the veracity and accuracy of the information provided to the Portal and for its appropriate use. The User must protect their login and password information, ensuring that they are not shared with third parties. Access to the Portal using your credentials will be your sole responsibility.

The Portal may make available to users technical devices called “access links” (connection between texts, pages and files), “banners” (display of images and graphic signs on pages, which identify advertising, advertising, etc.), directories and search tools that may access pages belonging to third parties (external page) or direct the user to third party websites (“linked sites”). The linked sites are not under the control of Frinsports, so Frinsports is not responsible for the content of any third party sites. Frinsports will provide these links to the User only for their convenience, and the User is responsible for reading and accepting the conditions of use published on third party websites. Any negotiations with third parties, participation in promotions, including the delivery of and payment for goods and services, and any other terms, conditions, warranties or representations associated with such negotiations or promotions, are solely between the User and the advertiser or third party. Frinsports will not be responsible for any part of any such dealings or promotions.

Frinsports does not guarantee or assume any type of responsibility for damages that may arise from: (i) the operation, availability, accessibility or continuity of external pages; (ii) maintenance of services, information, data, files, products and any type of material existing on external and internal pages; (iii) the provision or transmission of services, information, data, files, products and any type of material on linked websites; (iv) the legality, reliability and usefulness of the services, information, data, files, products and any type of material on external pages.

Privacy and Data Protection

Frinsports is committed to fully complying with the LGPD and respecting your privacy. The collection, storage and processing of Users' personal data is carried out in accordance with current legislation and the Privacy Policy [link] of the Portal, which describes how data is collected, used, protected and shared. We recommend reading the Privacy Policy [link] for detailed information about data processing.

Register

Login and password – The user himself will define his login (email) and personal password. In case of loss or change, it is possible to retrieve the password using a specific link in the system itself.

Changes – To change your data, such as login, password, address, email, etc., you must log in and access the “My Profile” option on the Event Portal or Frinsports Portal and change your personal information.

Conditions of Use of the Website

As a condition of using the Frinsports Portal, the User agrees not to violate the law, morality, good customs or any rights of third parties and not to use the services for illegal purposes or prohibited by these terms, and the User is not permitted to: 

(i) use the services in any way that violates applicable legislation, including illegal activities, such as piracy, copyright infringement, child pornography, gambling or other intellectual property laws; 

(ii) publish, transmit or share illegal, defamatory, slanderous, insulting, racist, xenophobic, obscene, pornographic information, or any content that violates the privacy of third parties, in addition to threatening, persecuting, defrauding, degrading, victimizing or intimidating an individual for any reason;

(iii) use the services in any way that may harm you or prevent the use of them by third parties; 

(iv) use the Services to attempt to gain unauthorized access to any other service, data, account or network by any means.

Payments

All payment requests will be made in the Portal environment (via the web platform). Frinsports does not forward invoices to users, nor does it have access to their card details.

Debit or credit card operations are carried out directly by a Payment Institution duly authorized by the Central Bank of Brazil, in accordance with Law No. 12,865/13, therefore we do not have access to any card data. Payment confirmation takes place within five minutes after the transaction is made. When the card transaction is not authorized, your order is automatically canceled.

Bank transfers must be made when registering on our Portal. Orders that are not paid at the time of registration will be automatically canceled in the system. Registration via bank transfer is done electronically. This way, the system identifies the payment and approves your order automatically. For this type of transaction, the User must have an electronic password from their bank. We do not accept any type of transfer or deposit that is not made through our Portal, as we will not be able to identify your payment.

Purchase Terms

Frinsports acts as an intermediary in the sale of tickets for events.

As a user, you declare that you are aware of and accept the following clauses and conditions:

• All content such as texts, photos and videos of events published in the Frinsports system are the sole responsibility of the event Organizer, whose data appears on the event page and which Frinsports does not exercise any prior control or supervision;
• The Event Organizer is solely responsible for planning, organizing and carrying out the event, being the one who defines the attractions, schedule, venue, dates, ticket prices, limit of available tickets, minimum and maximum ages, occasional discounts that may be offered, among others.
• Any change to the event schedule, whether changing dates, location or even cancellation, as well as any occurrences during the event, are the sole and exclusive responsibility of the Organizer.
• That all information declared by you when registering in the system and when purchasing tickets and registering for events through the Frinsports system is true and in accordance with current laws.
• That you are aware of and agree with the rules and terms of agreement of the events published in the Frinsports system in which you are going to participate.
• Who has the technical skills and is physically fit to participate in the events purchased on the Portal, exempting Frinsports and the Organizer from any problems that may occur due to participation in the same.
• In the event that you are registering on behalf of third parties, you have all the rights of representation of third parties, having authorization from the third party to provide registration data and, in cases of making purchases and registrations for them, declaring that the The third party who will participate in the event has technical skills and is physically able to participate in the events purchased on the Portal, exempting Frinsports and the Organizer from any problems that may occur due to participation in the event.
• That you authorize the use of your image rights, and that of third parties registered by you and from whom you have authorization, to promote the event, by the Organizer, Frinsports and sponsors.
• You are aware that the simple act of placing an order at Frinsports does not guarantee your entry to the event and does not guarantee your right to collect any kits, which are only guaranteed upon confirmation of payment of the full amount charged.
• You are aware that any payments made in an amount different from that actually due (whether lower or higher) will not generate a valid registration and will not guarantee your entry to the event or entitle you to the collection of any kits related to the event.
• You are aware that if registration entitles you to collect kits, they can only be collected on the dates and times set by the Organizer and provided for in the Event information. Failure to collect the kits on the established dates will result in the loss of your right to collect said kits.
• If you regret your purchase, regardless of the reason, the amount paid will be refunded as long as it is requested within 7 calendar days after placing the order and as long as it is less than 72 hours before the start of the event (or its delivery). kit when available). In this case, if the order was paid by credit card, the refund will be made to the same card used and will be credited to your next or subsequent invoice, in accordance with the card issuer's rules.
• Which exempts Frinsports from any liability related to the event, so that any complaints, such as, but not limited to, refund requests, cancellation of registrations and refund requests (except as provided in the item above) or any other matters related to the event shall be formulated directly to the Organizer.
• Which exempts Frinsports from any liability related to links on the Frinsports Portal or content signed by third parties, such as columns, blogs, comments in forums, videos, photos, comments in the news, training maps, among others, are the sole responsibility of their authors.
• That you are aware of the prohibition of reproduction of any content published on Frinsports, whether in full or in part, whether for commercial, personal or editorial use, unless prior written authorization from Frinsports or its author when identified.

Limitations

In no event shall Frinsports or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Frinsports, even if Frinsports or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply.

Precision of materials

The materials appearing on Frinsports Portal could include technical, typographical, or photographic errors. Frinsports does not guarantee that any material on its Portal is accurate, complete or current. Frinsports may make changes to the materials contained on its Portal at any time, without prior notice.

Frinsports has not reviewed all of the sites linked to its Portal and is not responsible for the content of any linked site. Its use is at the user's own risk.

Changes to Terms of Use

Frinsports reserves the right to modify these Terms of Use at any time, in order to reflect changes in legislation, the functioning of the Portal, or for any other reason. The changes will come into force immediately after being published on the Portal.

Final dispositions

This agreement is governed by the laws of Brazil and any disputes related to these Terms of Use will be resolved in the courts of that jurisdiction.

If any provision of these Terms of Use is considered invalid or unenforceable, the remaining provisions will remain in full force and effect.
